TAGSMOOTH TERMS OF SERVICE
OVERVIEW
Welcome to TagSmooth. The terms “we,” “us,” and “our” refer to TagSmooth. TagSmooth operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with an online shopping experience (the “Services”).
TagSmooth is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (“Terms”), describe your rights and responsibilities when you access or use our Services or purchase products from us.
Please read these Terms carefully before using our Services.
By visiting, interacting with, using our Services, or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.
Nothing in these Terms is intended to exclude or restrict any right or liability that cannot lawfully be excluded or restricted.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, country or jurisdiction of residence, or otherwise legally permitted to enter into the transaction.
You agree to provide accurate, current and complete information when using our Services or making a purchase, including your email address, billing information, payment information and shipping information.
You are responsible for maintaining the confidentiality and security of any account credentials associated with our Services and for activity occurring through your account.
You may not transfer, sell, assign or license your account to another person without our permission.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to provide accurate descriptions and representations of our products.
Colors, packaging, dimensions, appearance or other minor cosmetic characteristics may differ slightly from photographs shown on our website due to manufacturing variations, packaging updates, photography, screen settings or production batches.
Such differences do not permit us to materially misrepresent the product being sold.
TagSmooth Skin Tag Removal Kit
TagSmooth is intended for use on suitable skin tags only.
Do not use the product on:
- Moles
- Warts
- Unidentified or suspicious skin growths
- Irritated, inflamed, bleeding or infected skin
- Eyelids
- Genitals or other sensitive areas identified in the instructions
If you are uncertain whether a growth is a skin tag or whether the product is appropriate for you, seek advice from an appropriate healthcare professional before use.
You are responsible for reading and following all product instructions, warnings, sizing guidance and precautions.
Results
Individual results vary.
Where TagSmooth states that a skin tag typically falls off within 7–14 days, this is an estimated typical timeframe rather than a guarantee that every skin tag will fall off within that period.
Different individuals and different skin tags may respond differently.
Before-and-after photographs, reviews, testimonials or examples displayed on the Services illustrate individual experiences and do not guarantee identical results.
We do not guarantee a particular cosmetic outcome unless a specific guarantee is expressly stated by TagSmooth in writing.
SECTION 3 — ORDERS
By placing an order with TagSmooth, you acknowledge that you have had the opportunity to review and agree that your purchase is subject to these Terms of Service, our Return & Refund Policy, Shipping Policy, Privacy Policy, and any other applicable policies made available on our website. Nothing in these policies limits any mandatory consumer rights that cannot lawfully be excluded.
TagSmooth may accept or decline an order where reasonably necessary, including because of:
- Product unavailability
- Suspected fraud
- Payment problems
- Incorrect pricing or information
- Shipping restrictions
- Regulatory or legal restrictions
- Incorrect customer information
An order is accepted when we confirm acceptance and successfully process the required payment.
If we cancel an order after collecting payment, the applicable amount will be refunded.
Please review your order carefully before submitting it. Once an order has entered fulfillment or shipping, we may be unable to cancel or modify it.
Purchases are subject to our Refund Policy.
SECTION 4 — PRICES AND BILLING
Prices, discounts and promotions may change without notice.
The price charged for your purchase will generally be the price displayed when your order is submitted and confirmed.
We reserve the right to correct obvious pricing, typographical or technical errors.
If a material pricing error affects an order that has already been placed, we may contact you to offer the corrected purchase or cancel and refund the affected order.
Unless otherwise stated, product prices may not include shipping, taxes, customs, duties or other charges applicable to a particular destination.
You agree to provide current, complete and accurate billing and payment information.
You represent that you are authorized to use any payment method submitted for your purchase.
We may refuse, suspend or cancel an order where payment appears fraudulent or unauthorized.
SECTION 5 — SHIPPING AND DELIVERY
All delivery dates and delivery times displayed by TagSmooth are estimates unless expressly stated to be guaranteed.
Shipping may be affected by carriers, customs processing, destination-country procedures, weather, public holidays, logistical disruptions or other circumstances outside our reasonable control.
TagSmooth is not responsible for delays caused by shipping carriers, customs authorities or events outside our reasonable control, to the fullest extent permitted by applicable law.
Transfer of Risk
Once we transfer a product to the shipping carrier, title and risk of loss pass to you, to the fullest extent permitted by applicable law. By placing an order, you agree to this allocation of risk.
However, this provision does not exclude or restrict any mandatory delivery, refund or consumer right that applicable law does not permit the parties to waive.
You are responsible for providing a complete and accurate delivery address.
TagSmooth will not be responsible, to the fullest extent permitted by law, for losses or additional expenses resulting from an incorrect or incomplete address supplied by the customer.

SECTION 6 — INTELLECTUAL PROPERTY
The TagSmooth name, logo, original branding, original website content, graphics, designs and other materials owned by TagSmooth are protected by applicable intellectual-property laws.
Certain photographs, packaging, product materials, trademarks or other content may be owned by manufacturers, suppliers, Shopify, licensors or other third parties and remain the property of their respective owners.
Nothing in these Terms transfers any ownership rights to you.
You may not reproduce, distribute, commercially exploit, republish, modify or sell protected TagSmooth content without our prior written consent except where applicable law allows otherwise.
Shopify's trademarks and intellectual property remain the property of Shopify or its licensors.
SECTION 7 — OPTIONAL TOOLS
We may provide access to tools offered by third-party providers that we neither control nor monitor.
Such tools may be provided “as is” and “as available.”
To the fullest extent permitted by law, we are not responsible for losses arising solely from your use of independent third-party tools.
You should review the terms and policies of the applicable third-party provider before using those services.
SECTION 8 — THIRD-PARTY LINKS
Our Services may contain links to third-party websites, applications or services.
We do not control those third parties and are not responsible for their content, products, services, security, policies or practices.
Accessing third-party websites is at your discretion.
Complaints relating solely to a third party's independent products or services should be directed to that third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
TagSmooth is powered by Shopify, which enables us to provide the Services.
However, purchases made through the TagSmooth store are transactions directly between you and TagSmooth.
Shopify is not the seller of TagSmooth products.
To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses or damages arising from products purchased directly from TagSmooth.
SECTION 10 — PRIVACY POLICY
Personal information collected through our Services is handled according to our Privacy Policy.
Because Shopify hosts our Services, Shopify may collect and process certain personal information relating to your use of our store.
Information may also be processed by payment providers, fulfillment providers, shipping companies and other service providers where reasonably necessary to operate our Services and complete your transaction.

SECTION 11 — FEEDBACK, REVIEWS AND USER CONTENT
If you voluntarily submit reviews, photographs, videos, suggestions, testimonials, comments or other content (“Feedback”), you represent that you have the necessary right to provide that content.
By submitting Feedback directly to TagSmooth for publication or promotional purposes, you grant TagSmooth a non-exclusive, worldwide, royalty-free license to reproduce, display, publish and use that Feedback in connection with our Services and marketing.
We will not knowingly alter genuine customer feedback in a way that materially misrepresents the customer's experience.
You may not submit:
- Fake reviews
- Reviews under a false identity
- Content you do not have permission to use
- Unlawful or defamatory material
- Malicious software
- Knowingly misleading information
We may remove content that violates these Terms or applicable law.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Information on our Services may occasionally contain errors, inaccuracies or omissions concerning:

- Prices
- Promotions
- Availability
- Shipping costs
- Delivery estimates
- Other store information
We reserve the right to correct genuine errors and update inaccurate information.
If a material error affects an existing order, we will handle the matter fairly and in accordance with applicable law.

You remain responsible for amounts lawfully due before termination.
Provisions that by their nature should survive termination will continue to apply.
SECTION 16 — DISCLAIMER OF WARRANTIES AND PRODUCT RESULTS
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, and except for warranties or promises expressly made by TagSmooth, the Services and products are provided on an “as is” and “as available” basis.
TagSmooth disclaims warranties, representations or conditions that may lawfully be disclaimed, whether express or implied, including warranties of merchantability, fitness for a particular purpose, durability and non-infringement.
We do not guarantee:
- That every individual will achieve the same result
- That every skin tag will fall off within a specific number of days
- A completely pain-free experience
- That no irritation, mark or other individual reaction can occur
- That the Services will always operate uninterrupted or error-free
Unknown defects
To the fullest extent permitted by applicable law, TagSmooth does not assume responsibility for a defect that was not known to TagSmooth and could not reasonably have been known by TagSmooth, except where applicable law imposes a responsibility that cannot be waived.
Nothing in these Terms permits TagSmooth to knowingly conceal a material defect or make a false statement about a product.
If TagSmooth becomes aware of a material product issue, we may investigate, correct product information, contact affected customers where appropriate, suspend sales, seek remedies from our supplier or manufacturer, or take other reasonable corrective action.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TagSmooth, its owners, affiliates, employees, contractors, agents, suppliers and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost revenue, lost savings, lost data, business interruption or similar losses arising from your use of the Services or products.
Without limiting the above, TagSmooth is not responsible, to the fullest extent permitted by law, for injury, loss or damage caused by:
- Failure to follow product instructions
- Incorrect application of the product
- Using an unsuitable band size
- Using the product for anything other than its intended purpose
- Using the product on moles, warts or unidentified growths
- Using the product on prohibited or sensitive areas
- Using the product on irritated, infected or damaged skin contrary to instructions
- Failure to maintain appropriate cleanliness or hygiene when using the product
- Contamination occurring after the product has been delivered
- Modification or misuse of the product
- Individual skin sensitivity or individual differences that are not attributable to a product defect or wrongful act by TagSmooth
- Continued use after an adverse reaction becomes apparent
- Conduct of independent third parties outside TagSmooth's reasonable control
The occurrence of irritation, infection, scarring or another adverse outcome does not by itself establish that TagSmooth caused or is legally responsible for that outcome.
Customers should stop using the product and obtain appropriate healthcare advice if they experience signs of infection, a significant adverse reaction or another concerning medical issue.
Where a complaint suggests a possible product defect or safety problem, TagSmooth may reasonably request information necessary to investigate the complaint, such as order information, photographs, details concerning use of the product and available batch or packaging information.
Maximum lawful protection
These limitations apply to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits liability to the extent that applicable law does not permit it to be excluded or limited.
Nothing in these Terms protects TagSmooth from responsibility for fraud, intentional deception or the deliberate concealment of a material defect known to TagSmooth.
SECTION 18 — INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless TagSmooth, Shopify, and their respective affiliates, owners, officers, employees, contractors, agents, licensors and service providers from third-party claims, losses, liabilities and reasonable legal expenses arising from:
- Your material breach of these Terms;
- Your unlawful use of the Services;
- Your violation of another person's rights; or
- Your misuse of the product contrary to clear instructions or warnings.
This provision does not require you to indemnify TagSmooth for liability that TagSmooth cannot lawfully transfer to you.
SECTION 19 — SEVERABILITY
If any part of these Terms is determined to be unlawful, void or unenforceable, that provision will be limited or severed only to the extent necessary.
The remaining provisions will remain effective.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms immediately does not constitute a permanent waiver of that provision.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and other policies incorporated by reference, constitute the agreement governing your use of the Services.
No provision should be interpreted as overriding a mandatory legal right that cannot lawfully be waived.
SECTION 21 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent except where applicable law permits otherwise.
We may transfer or assign our rights and obligations where reasonably necessary for legitimate business purposes, including a restructuring, acquisition, sale or transfer of the TagSmooth business.
SECTION 22 — GOVERNING LAW
These Terms and any separate agreements through which TagSmooth provides Services shall be governed and construed in accordance with the laws applicable in the jurisdiction in which TagSmooth is legally established, without prejudice to mandatory consumer-protection rights that may apply to a customer and cannot lawfully be waived.
The parties agree to attempt in good faith to resolve disputes directly before pursuing formal proceedings where reasonably practicable.
Nothing in these Terms prevents either party from exercising a legal right to use an applicable court, regulator, consumer authority or dispute-resolution procedure.

The headings in these Terms are included for convenience only and do not limit or otherwise affect their interpretation.

We may update these Terms from time to time to reflect changes in our Services, business practices or applicable requirements.
Material changes will take effect as required by applicable law.
Changes will not retroactively remove rights arising from a completed transaction where doing so is not legally permitted.
